Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Munchease. They govern your use of our website, app, and the operator “cockpit” used by restaurants (together, the “Platform”). Please read them carefully. By creating an account, placing an order or booking, listing a business, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Who we are

Munchease (“Munchease”, “we”, “us”, “our”) is a Trinidad & Tobago-based operation trading under the Munchease name, providing a platform for discovering food businesses in Trinidad & Tobago and the wider Caribbean, viewing their menus, placing pickup and dine-in orders, and — where offered — requesting tables. If the underlying entity is formalised (for example, registered as a limited company or sole trader), these Terms will be updated to name it.

2. What Munchease is — and what it is not

Munchease is a platform that connects you with independent restaurants and food businesses. We are a venue and a set of tools; we are not a restaurant, a food seller, a courier, or a payment processor.

  • When you place an order or booking, the resulting agreement is directly between you and the restaurant. Munchease is not a party to that agreement and does not buy, sell, prepare, handle, or deliver any food or drink.
  • Menus, item descriptions, prices, availability, opening hours, allergen and dietary information, promotions, and fulfilment are provided and controlled by each restaurant. We display this information but do not guarantee that it is accurate, complete, current, or error-free.
  • We do not process payments in the app and do not collect or store card or bank details. You pay the restaurant directly — in person at pickup, or by arrangement (for example, over WhatsApp).
  • Any delivery, if offered, is arranged by the restaurant or a third party, not by Munchease.

3. Eligibility and your account

You must be at least 13 years old to use the Platform, and old enough to form a binding contract to place orders or bookings. If you act on behalf of a business, you confirm you are authorised to bind that business to these Terms.

You are responsible for the information you provide and for keeping your account secure. Keep your login details confidential; you are responsible for activity under your account. Tell us promptly if you suspect unauthorised use. Sign-in is handled by our authentication provider. We may refuse, suspend, or close accounts as described in section 11.

4. Orders, bookings, prices, and payment

  • Orders and bookings. Placing an order or requesting a table is an offer to transact with the restaurant. The restaurant may accept, decline, or cancel it, and is responsible for fulfilling it. Pickup codes, order-tracking links, and booking requests are tools to help — they do not make Munchease a party to your transaction.
  • Prices and taxes. Prices, taxes (including VAT where applicable), and any service or other charges are set and displayed by the restaurant. They may change, and errors can occur; the restaurant is responsible for honouring or correcting its own pricing.
  • Payment. You pay the restaurant directly. Munchease does not take payment, hold funds, or issue refunds.
  • Cancellations, no-shows, refunds, and disputes. Any cancellation, refund, no-show, substitution, or complaint about an order or booking is a matter between you and the restaurant, subject to the restaurant's own policies and applicable law. We can try to help, but we are not obliged to resolve it and are not liable for the outcome.
  • Food safety, allergens, and suitability. The restaurant is solely responsible for the preparation, quality, safety, and labelling of its food and drink, and for the accuracy of allergen and dietary information. If you have an allergy or intolerance, confirm directly with the restaurant before ordering.
  • Age-restricted items. Where a restaurant offers alcohol or other age-restricted items, the restaurant is responsible for verifying eligibility and complying with the law.

5. Reviews, votes, and content you post

You may be able to post reviews (tied to a completed order), ratings, photos, and other content. You must own or have the right to what you post, and it must be truthful and lawful. You must not post content that is false, defamatory, misleading, abusive, hateful, obscene, infringing, or that reveals another person's private information.

You keep ownership of what you post. You grant Munchease a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, and distribute that content on and in connection with the Platform (for example, showing your review on a restaurant's public profile). We may screen, moderate, refuse, edit for display, or remove content, and may withhold or remove reviews that breach these Terms — but we are not obliged to monitor content and are not responsible for content posted by users.

Voting in campaigns. During a seasonal menu campaign you may be able to vote for restaurants. Voting is limited to one vote per restaurant per person, and it is a way for diners to show support — it is not a review, a ranking, or a guarantee of how prominently a restaurant appears. You must not attempt to inflate or distort a result: no automated voting, no multiple accounts or devices used to vote more than once, and no paying or inducing others to vote. Where we believe votes have been manipulated we may discount or remove them, and we may adjust, suspend, or end a campaign at any time. Vote totals may be shown publicly; who voted is never shown.

6. If you operate a restaurant on Munchease

These Terms also apply to businesses and their team members. If you list or run a business on the Platform, you additionally agree that:

  • You are responsible for your content — menus, prices, images, descriptions, hours, promotions, and contact details — and for keeping it accurate and up to date.
  • You will honour the orders and bookings you accept, and fulfil them lawfully and in line with what you have published.
  • You are responsible for all licences, permits, registrations, food-hygiene and safety standards, tax obligations (including VAT), consumer-protection and advertising rules, and any alcohol or age-restricted-item requirements that apply to your business.
  • You grant Munchease a licence to display and promote your content and business on the Platform and in related marketing, and you confirm you have the rights to grant this.
  • Where paid plans or fees apply, they are as described at sign-up or on our pricing materials. Fees, quotas, and included features may change on reasonable notice. Some features may be offered on a trial, promotional, or “beta” basis.
  • A restaurant only ever sees the details and order history of people who dealt with its own branches. You must not use another business's customer information, or use Platform data other than to serve your own customers, and you must comply with applicable data-protection law.

7. Acceptable use

You agree not to:

  • use the Platform for anything unlawful, fraudulent, or harmful, or to place orders or bookings you do not intend to honour;
  • post or transmit unlawful, infringing, deceptive, or abusive content, or impersonate anyone;
  • interfere with, disrupt, probe, or attempt to gain unauthorised access to the Platform or its systems;
  • scrape, harvest, copy, or bulk-extract data from the Platform, or use it to build a competing product, without our written permission;
  • misuse another user's or business's information, or circumvent any access, rate, or security control.

8. Intellectual property

The Platform, the Munchease name, logo, and branding, and the software, design, and content we provide are owned by Munchease or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Platform for its intended purpose. You may not copy, modify, distribute, or create derivative works from our materials except as these Terms allow or the law permits. Restaurant and user content remains the property of whoever provided it.

9. Third-party services and links

The Platform relies on and links to third-party services — for example, our authentication provider, messaging tools such as WhatsApp, mapping, hosting, and analytics providers. We do not control those services and are not responsible for them; your use of them may be subject to their own terms. Links to third-party sites are provided for convenience and are not an endorsement.

10. Availability, changes, and disclaimers

We work to keep the Platform running well, but we provide it “as is” and “as available”. We may change, suspend, or discontinue features, and we do not promise the Platform will be uninterrupted, error-free, or secure, or that information on it is accurate.

To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In particular, we make no warranty about any restaurant, or about the quality, safety, legality, or fitness of any food, drink, service, order, or booking — those are the restaurant's responsibility. Nothing in these Terms excludes rights or guarantees that applicable law says cannot be excluded.

11. Suspension and termination

You may stop using the Platform at any time and can ask us to close your account. We may suspend or terminate your access — immediately where reasonable — if you breach these Terms, if we are required to by law, or to protect the Platform, other users, restaurants, or the public. Provisions that by their nature should survive (for example, sections on content licences, intellectual property, disclaimers, liability, indemnity, and governing law) continue after termination.

12. Limitation of liability

To the fullest extent permitted by law, Munchease will not be liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profits, revenue, goodwill, data, or opportunity, arising out of or relating to your use of the Platform or any transaction with a restaurant — including any issue with food, an order, a booking, a payment made to a restaurant, or a restaurant's acts or omissions.

To the fullest extent permitted by law, our total liability for all claims relating to the Platform in any twelve-month period is limited to the greater of (a) the total fees you paid to Munchease in that period, or (b) TT$500 (or its equivalent). Because you pay restaurants directly and not Munchease, amounts you pay a restaurant are not fees paid to Munchease.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law — such as liability for death or personal injury caused by our negligence, for fraud, or for any statutory rights that cannot be waived.

13. Indemnity

To the extent permitted by law, you agree to indemnify and hold Munchease harmless from claims, losses, and reasonable costs (including legal costs) arising from your breach of these Terms, your misuse of the Platform, your content, or — if you are a restaurant — your products, services, or fulfilment of orders and bookings.

14. Governing law, disputes, and the Caribbean

These Terms are governed by the laws of Trinidad & Tobago, and the courts of Trinidad & Tobago have jurisdiction over any dispute — except that, if you are a consumer in another Caribbean country, you keep the benefit of any mandatory consumer-protection rights and any right to bring proceedings that the law of your country of residence gives you and does not allow to be waived.

Before starting formal proceedings, please contact us (section 16) so we can try to resolve the matter informally.

15. Regional availability and your local law

The Platform is operated from Trinidad & Tobago and offered in Trinidad & Tobago and, where available, the wider Caribbean. We make no representation that the Platform, any restaurant, or any content is appropriate or available in every location. If you use the Platform from elsewhere, you do so on your own initiative and are responsible for complying with your local laws.

16. Changes to these Terms

We may update these Terms as the Platform changes. We will post the updated version with a new “Last updated” date and, where changes are significant, take reasonable steps to let you know. By continuing to use the Platform after an update takes effect, you accept the updated Terms.

17. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. You may not transfer your rights or obligations under these Terms without our consent; we may transfer ours as part of a reorganisation, sale, or similar event. These Terms, together with our Privacy Policy and any plan or feature terms we present, are the entire agreement between you and Munchease about the Platform.
